Article 1 - Scope of application

The present General Terms and Conditions of Sale (GTCS), as defined below and in their most recent version applicable on the date the order is placed, are intended to govern all commercial and contractual relations between CAR PARTS FRANCEhereinafter referred to as "the seller" or "us", and any individual or legal entity, acting as a consumer or professional, placing an order for used car parts via one of the channels made available by the seller, namely but not limited to: by telephone, by e-mail, via online sales platforms or directly on the seller's official website, hereinafter referred to collectively as "the buyer", "the customer", or "you". By expressly or implicitly accepting these GTC, simply by completing an order, signing an order form or electronically validating any order form on the site, you agree to comply without reservation with all the clauses, terms, restrictions, terms, conditions and obligations set forth herein, including, but not limited to, those relating to prices, payment terms, delivery times, legal and contractual warranties, and any limitation of the seller's liability, as explicitly defined in the following articles. CAR PARTS FRANCEreserves the right to unilaterally modify these GTC without prior notice, with modifications taking effect as soon as they are published online or disseminated by any other appropriate means. It is the customer's responsibility to regularly consult the updated GTC, whose applicable version will be that in force at the time of the order.

Article 2 - Orders

Orders can be placed by telephone, e-mail or directly online on the CAR PARTS FRANCEAll orders are subject to full acceptance, without restriction or reservation, of these GTS and of the information relating to the products appearing on the site at the time of the order, including but not limited to: part descriptions, quantities, prices indicated, the latter being subject to change at any time according to market fluctuations, stock availability, or any other external factor beyond the control of the seller. All orders are considered firm and definitive as soon as they have been registered by CAR PARTS FRANCE. However, CAR PARTS FRANCE reserves the right to refuse or cancel any order, notably but not exclusively in the event of: non-payment, a previous dispute with the customer, an obvious error in the price or description of the product, or any legitimate legal or commercial reason, without the seller being held liable in any way whatsoever. It should be noted that validation of an order by the customer implies full knowledge and unreserved acceptance of the present terms and conditions, including those relating to specific delivery conditions, return procedures and warranty exclusions.

Article 3 - Payment

All payments, whether by bank transfer, cheque, credit card or PayPal, must be made in euros. The total amount of the order, including any delivery, packaging or other additional charges explicitly indicated at the time of order confirmation, must be paid in full before the order can be processed. CAR PARTS FRANCE reserves the right to suspend any order or delivery in the event of non-payment or partial payment, as well as in the event of suspicion of fraud, doubt as to the buyer's identity, or any other situation that could compromise the proper execution of the sales contract. In the event of payment by cheque, the order will only be processed on receipt of the cheque and after it has been cashed by CAR PARTS FRANCEadditional time is required. In the event of non-payment, refusal of payment by the bank or any other payment incident, CAR PARTS FRANCE reserves the right to cancel the order, without prejudice to any legal action or collection proceedings against the defaulting buyer. All payments made to the seller by the buyer are deemed final and irrevocable, unless otherwise expressly stipulated in the present GTCS or by court order.

Article 4 - Delivery

Deliveries of used car parts ordered from CAR PARTS FRANCE are carried out by a third-party carrier, the choice of which is left to the discretion of the seller, unless expressly requested and accepted in writing by the purchaser. Delivery charges, whether fixed or variable according to the volume, weight or destination of the parts ordered, are entirely at the buyer's expense and are communicated before final validation of the order. The delivery times indicated at the time of ordering are purely indicative and can in no way be considered as contractual. CAR PARTS FRANCE cannot be held responsible for delays in delivery attributable to the carrier, customs, force majeure or any other cause beyond the seller's control. In the event of significant delay or loss of the parcel, it is the buyer's responsibility to make any claim directly to the carrier, without engaging the responsibility of the seller. CAR PARTS FRANCE. No indemnity, penalty or compensation may be claimed in the event of late delivery or failure to deliver.

Article 5 - Warranty

Used car parts sold by CAR PARTS FRANCE have a contractual warranty of 3 months from the date of delivery, unless otherwise specified. This warranty, limited to manufacturing or material defects affecting the part concerned, excludes any other form of warranty, express or implied, and in particular those relating to peripheral parts, accessories or other components left free of charge, such as but not limited to: ECUs, wiring, mechatronics, oil pumps, alternators, starters, solenoids, or any other secondary equipment included in the order. CAR PARTS FRANCE reminds the purchaser that it is imperative to install parts in accordance with the original manufacturer's technical recommendations, and in compliance with each stage of the official technical review. Incorrect or incomplete installation, or installation that does not comply with the manufacturer's specifications, may invalidate the warranty. In the event of any failure or defect occurring during the warranty period, the purchaser must immediately notify CAR PARTS FRANCE in writing, providing proof of purchase and a detailed description of the defect observed. CAR PARTS FRANCE reserves the right to request an appraisal of the returned part before offering, at its sole discretion, a replacement or refund. No returns will be accepted without prior agreement from the seller.

Article 6 - Returns

Parts returns are accepted only after written approval from CAR PARTS FRANCEThis is subject to the parts being returned in their original condition, undamaged, unmodified and accompanied by all accessories and original documents. Return shipping costs are the sole responsibility of the purchaser, except in the event of an error attributable to the seller. CAR PARTS FRANCE reserves the right to refuse any return that does not comply with these conditions, with no obligation to refund or replace.

Article 7 - Engine sales

Used engines offered for sale by CAR PARTS FRANCEOur products, whether complete or partially assembled, are accompanied, strictly free of charge, by certain peripheral components and accessories, such as but not limited to: alternators, water pumps, oil pumps, starters, belts, pulleys, or any other accessory items that may be included in the delivery, the latter being considered as additional parts that are not essential to the main operation of the engine. These accessories are supplied without any contractual, legal or implicit guarantee, and the purchaser expressly acknowledges that they are provided free of charge, without any financial consideration, which excludes any claim, replacement or possible compensation in the event of malfunction, breakdown or defect of these elements. It is therefore the sole responsibility of the purchaser, prior to any installation or commissioning of the motor or its ancillary components, to carry out all necessary tests and checks to ensure their conformity, functionality and compatibility with the vehicle intended to receive them. CAR PARTS FRANCE declines all responsibility for any malfunction, mechanical failure or subsequent deterioration of the motor or associated accessories, when such incidents result from improper installation, inappropriate handling, inadequate or abusive use, or failure to follow the installation procedures recommended by the original manufacturer. Furthermore, the purchaser is aware that any modification, alteration or repair carried out on the components without the prior written consent of CAR PARTS FRANCEwill result in the pure and simple cancellation of any form of guarantee or possible recourse. Finally, please note that CAR PARTS FRANCE cannot be held responsible for any direct or indirect consequences resulting from the use, installation or operation of second-hand motors and associated parts in conditions that do not comply with the manufacturer's standards or generally accepted industry practice.

Article 8 - Intellectual property

All content on the CAR PARTS FRANCEThe content of this site, whether editorial, graphic, visual, sound or other, including but not limited to: texts, articles, product descriptions, photographs, illustrations, logos, technical diagrams, multimedia elements, videos, and all other original creations or data made available on the site, are the exclusive property of CAR PARTS FRANCE or its duly authorized partners and suppliers. These elements are protected by the legal and regulatory provisions in force relating to intellectual property rights, and in particular by the French Intellectual Property Code, international conventions applicable in this area, and other laws in force, covering copyrights, trademarks, patents, designs and models, as well as any other related or accessory rights. Any reproduction, representation, distribution, adaptation, modification, publication, transmission, or exploitation, in whole or in part, of these elements in any form whatsoever, by any process or medium whatsoever, without the express, prior and written authorization of CAR PARTS FRANCEis strictly prohibited and constitutes an infringement liable to civil and criminal prosecution. For further information, CAR PARTS FRANCE reserves the right to claim damages for any unauthorized use of its protected elements, and to take any appropriate legal action to enforce its rights. The user of the website expressly acknowledges that mere consultation or browsing of the site does not confer any right of ownership or any other right of use over the protected elements, and that any infringement of the provisions of the present article may result in serious sanctions, without prejudice to any additional measures that may be taken by the company. CAR PARTS FRANCE to protect its commercial and legal interests.

Article 9 - Limitation of liability

Under no circumstances, and at no time, CAR PARTS FRANCE shall not be liable for any damage, loss or injury, whether direct, indirect, incidental, consequential or in any way connected with the use, installation or failure of any part sold, whether an engine, gearbox, electronic component or accessory, insofar as such damage is not exclusively due to an obvious manufacturing defect or latent defect directly affecting the part in question under normal conditions of use. The liability of CAR PARTS FRANCE is strictly limited, in all cases, to the value of the good sold as indicated on the corresponding invoice, to the exclusion of any other amount or repair, including but not limited to: labor costs, costs related to the immobilization of the vehicle, operating losses, damages for moral prejudice, or any other type of damage, even if the latter are invoked as indirect consequences of a defect or malfunction of the part sold. CAR PARTS FRANCE shall not be held responsible for improper handling, installation by unqualified third parties, or use of parts for purposes other than those for which they were originally intended. Furthermore, any unauthorized intervention or modification carried out on parts automatically invalidates any warranty and releases CAR PARTS FRANCEfrom any further liability. By accepting these GTC, the purchaser acknowledges that he/she is aware of this limitation of liability and accepts it unreservedly, particularly with regard to the financial, material and immaterial consequences of using the products purchased.

Article 10 - Sale of gearboxes

Used gearboxes marketed by CAR PARTS FRANCE are supplied, unless otherwise expressly stipulated, with certain additional peripheral components, such as, but not limited to: mechatronics, oil pumps, solenoids, torque converters, electronic wiring, various sensors and other accessory items. These components are provided free of charge at the seller's discretion, and are not covered by any warranty, whether contractual or legal, explicit or implicit. It is expressly stated that CAR PARTS FRANCE cannot be held responsible for the correct operation or condition of these peripheral components, which are supplied as is, with no possibility of return, exchange or replacement in the event of defect. The purchaser further acknowledges that the installation of a gearbox, with or without the ancillary components supplied, must be carried out in accordance with the strict specifications of the original manufacturer, as described in the technical review and service manuals of the corresponding vehicle. Any non-conforming installation, any failure to follow the recommended steps rigorously, or any work carried out by an unauthorized or unqualified professional, will invalidate any warranty on the gearbox and will exonerate CAR PARTS FRANCE from any liability whatsoever in the event of malfunction, premature wear or failure of the transmission system. In addition, CAR PARTS FRANCEcannot be held responsible for indirect or incidental damage resulting from incorrect assembly, improper use, or lack of maintenance of the gearbox or its peripheral components. Any claim concerning a gearbox must be made within 48 hours of receipt of the part, and accompanied by clear and precise proof, including but not limited to: the purchase invoice, installation reports carried out by a certified professional, and photographic or video evidence demonstrating the anomaly encountered. In the event of an accepted return, CAR PARTS FRANCE reserves the right to carry out a thorough appraisal before deciding on the possibility of a refund or replacement, subject to the terms of these GTC.

Article 11 - Exclusion of the right of withdrawal

In accordance withArticle L221-28 of the French Consumer Codethe right of withdrawal does not apply to orders for used spare parts requiring professional assemblyincluding gearboxes and engines.

The return of a gearbox or an engine is strictly forbiddenexcept in the case of a proven defect certified by an independent expert appointed by CAR PARTS FRANCE.

This exclusion is justified for the following reasons:

Technical and inseparable A gearbox or engine contains a number of internal components (mechatronics, sensors, converters, etc.), whose integrity cannot be guaranteed once they have been delivered to the customer.
Risk of fraud or substitution CAR PARTS FRANCE cannot check whether components have been dismantled, replaced or modified after delivery.
Professional installation required A gearbox installed or handled without respecting the manufacturer's recommendations may suffer damage not covered by the warranty.

All gearbox and engine returns are subject to the following conditions automatically refusedCAR PARTS FRANCE will not be held responsible for any damage to the vehicle, unless CAR PARTS FRANCE approves an exceptional decision based on technical expertise.

Other used parts sold by CAR PARTS FRANCE may be subject to a right of withdrawal, provided they are have not been installed, used or modifiedand that they are returned in their original packaging with all accessories.

Article 12 - Force majeure

In the event of force majeure, CAR PARTS FRANCE cannot be held responsible for the non-performance or delay in the performance of its obligations.
